Images, Video & Music Licensing
Recently, we have observed a growing number of scams and emerging risks associated with image and media file licensing. At the same time, costs for obtaining image & other media licenses have increased significantly. In the past, Wish have not always passed on charges for image purchases and have absorbed these costs, however we are unable to continue to do so going forward.
To ensure clarity and transparency in the services we provide, we want to elaborate on some key points regarding the usage of licensed assets.
First and foremost, it’s imperative to understand that all images and videos included within the creative projects we deliver are licensed specifically for that intended use only. This means that they cannot be utilised in any other context under the same license agreement. These assets cannot be repurposed or utilised in any other manner without obtaining additional licenses – which we can of course help you with.
In addition, any images or videos provided to you in their original format in the past, by Wish or any other source, require new licenses if they are to be used beyond their initial purpose. In essence, each usage scenario necessitates a separate licensing arrangement to comply with legal and ethical standards.
We also want to clarify for the avoidance of doubt surrounding past purchases made through Wish or similar platforms. Where we have referred to “purchases,” in invoices, we are specifically addressing the acquisition of licenses for the designated use within the projects we undertake on your behalf. These licenses are tailored to the scope and duration of the creative work in question
There can only be one rights holder for each downloaded image file, so, if Wish transfer the raw, unedited file to you, as our client, we must then notify our supplier (currently Shutterstock) of your business details. This is because when the file is transferred, your business becomes a Shutterstock customer in effect, and they must know who you are in the event they need to notify your business of a claim on an asset. From the 1st July 2024, unless otherwise agreed in writing, all images, music or video content licenses purchased on your behalf will incur the following costs (excluding VAT).
Images
- Small Project: £25
- Large Project: £90
Video Content
- All uses: £90
Music Content
- All uses: £90
Small or Large Project
- Small project refers to a project budget under $10,000 (or equivalent) and with less than 500,000 expected views.
- Large project refers to a project budget over $10,000 (or equivalent) and / or with more than 500,000 expected impressions / views.
Please note all media licences only become chargeable if watermarked images are chosen and approved when the creative work is complete. At the end of each month, an invoice will be issued detailing all media license purchases.
As an alternative to the above method, monthly agreements can be revised to include specific budget allocated to asset license purchases. Where this is 10% or more of the monthly fees, we are happy to provide a discounted rate on asset licenses to £20 and £80 respectively. Please contact us to discuss this option.
Please see our our terms of service, which includes a paragraph entitled copyright and we draw your attention to this.
Lastly, when you provide images, video, music or any other such content to Wish, our internal Image Policy asks our team to request confirmation in writing that you hold all necessary licenses to use the content you are supplying.
We know you will appreciate the importance of adhering to licensing agreements to protect both your interests and the integrity of our creative endeavours.
